We suggest that you carefully read the terms and conditions detailed below. They form the basis of the sale agreement between you and First Christmas, LLC, whenever you purchase one or more of our products online. When you proceed with a purchase, you are acknowledging that you have read these terms and conditions of sale and that your purchase from us is subject to them.

These terms and conditions may change from time to time. We therefore recommend that you review them at the time of any additional purchases on our website, for these will be the terms and conditions that affect you. First Christmas, LLC commissioned and purchased from professional artists and designers the designs used in the gift wrap found in our 2009 Store and the concept art found in our Gallery 2010. This artwork is protected by copyright. Please do not attempt to appropriate it for uses other than intended by First Christmas, LLC.

This website and all its pages, artwork, text, files, and graphics are also protected by copyright owned by First Christmas, LLC, all rights reserved. They may not be copied, displayed, or otherwise utilized without the prior written consent of the managing officer of First Christmas, LLC, except in the normal intended use for the purchase or consideration of purchase of the products for sale here.


Pricing

Our product offerings are limited and seasonal, and we have tried to make them as uncomplicated as possible. We have also attempted to establish prices that are reasonable for both our customers and our needs as a business. We do not expect to change non-sale prices on our products during any given Christmas season, although prices may change from year to year. However, the prices displayed on our website at any point in time are current at that particular point in time, and First Christmas does reserve the right to alter our prices at anytime without notice. When price changes do occur, they will be updated on the website, such as at the beginning or end of a special sale.


Sales Tax

No sales tax is collected on internet sales if the purchase is made from outside the State of Utah. Utah residents must pay a 6.75% sales tax calculated on the price of the product(s) being purchased before the addition of charges for shipping and handling.


International Customers

First Christmas welcomes orders from outside of the continental United States. However, our website does not provide for transactions outside of the United States due to differences in regulations and possible tariffs and/or freight charges. If you wish to order from outside the United States, please e-mail your order to us. We will process your transaction separately and notify you of what charges to expect.

All overseas customers must be aware that any shipping, tariffs, duties, and taxes levied in your respective countries will need to be paid by you. For any goods ordered from our site to a delivery address outside the State of Utah, no sales tax will be charged by First Christmas, LLC.


Shipping and Delivery

After much research and thought, we offer only one shipping option. In order to ship our specialty sheets unfolded and with maximum protection from damage, and in order to accommodate seasonal orders within several days of Christmas, we ship all products directly to your home or another designated address by FedEx using their 3-day Air delivery option. Orders that have cleared the PayPal system will be shipped within 1 business day of receiving your order. Most products will therefore arrive within 3-5 business days of the date you place your order. If your order remains undelivered after 5 business days, please Contact Us and we will explore the delay in your delivery. FedEx allows us to track the shipping progress of each package.


Shipping and Handling Costs

The prices for products shown on our web site do not include shipping and handling. A standard shipping cost has been applied to each product based on the weight of the product, the average distance a package is likely to travel, and certain one-time handling charges like pulling the product from the warehouse, rolling our specialty sheets for placement in triangular tubes, and printing the shipping label.

We have tried to keep the shipping charge to a minimum while employing an option that will both maximize protection of the unfolded product and guarantee reasonable timeliness in delivery. Our Best Value Set minimizes the shipping and handling charge per sheet of gift wrap in addition to providing a cost savings per sheet.

An extra handling charge may be applied to particular orders – for example, to orders delivered to Hawaii or Alaska. On occasion, when an order must be delivered to any remote destination relative to our fulfillment warehouse, we will contact the customer by phone or e-mail to advise you of unusual freight charges that may apply. We recommend that you designate a delivery location where someone will be available during business hours to receive the delivery.


Returns

Please Contact Us immediately if your order was damaged during shipping so we can ship a new order or arrange a refund. We will give you instructions appropriate for the situation. Also Contact Us right away if you are not happy with the product since returns must be made within 7 days. We will give you instructions at that time for returning your order and receiving your refund for the purchase price. There can be no refund of shipping and handling charges.

Availability of Product

In 2009, our start-up year, we have attempted to print enough gift wrap to fulfill anticipated demand. However, this is an inexact science. We will be tracking supplies and orders in an attempt to anticipate orders that may exceed our current supplies. If sufficient time remains prior to Christmas, we will print more wrapping paper. If a gap in our product supply affects your order, we will notify you of that fact and give you the opportunity to either cancel the order or agree to wait until more gift wrap is available.


Limitation of Liability

In no event shall First Christmas, LLC, be liable for any indirect, special, incidental, or consequential damages or loss beyond the value of the products purchased.


Authority to Purchase from First Christmas

By accepting our terms and conditions of sale, you are acknowledging that you have the authority to enter into a commercial transaction with First Christmas, LLC, including the use of a credit card, if applicable. By making a purchase on behalf of a company or business, individuals represent that they have appropriate authority to enter into such a transaction on the company’s behalf.


Force Majeure

First Christmas, LLC shall not be liable for any delay in performing its obligations under these terms and conditions, where such delay is caused by circumstances beyond our reasonable control. First Christmas,LLC shall be entitled to a reasonable extension of time for the performance of its obligations under such circumstances.
